The website www.vitiscordis.fr, operated under the trade name Vitis Cordis, is published by Thomas Stasse, sole trader (French "micro-entreprise"), registered at [ADDRESS TO BE COMPLETED], SIRET [TO BE COMPLETED], holder of off-premise sales licence n°[TO BE COMPLETED], reachable at contact@vitiscordis.fr.
These terms apply exclusively to the online sale, via the site, of the vine sponsorship packages offered by Vitis Cordis: Discovery, Passion, Privilege and Champagne Immersion, as well as the gift offer and the business offer.
Confirming an order constitutes full acceptance of these terms, as in force on the day of the order.
The sponsorship relates to a real vine, grown by Vitis Cordis on its plot in Mutigny. The Champagne bottles included in certain packages are purchased by Vitis Cordis from a partner Champagne house, then resold to the customer as part of the offer: Vitis Cordis acts here as a reseller, not as the producer of these bottles.
By confirming their order, the customer warrants that they are at least 18 years old on the date of the order. The sale of Champagne is prohibited to persons under 18 years of age.
Each package is described on the site (content, price, bottles included where applicable). These descriptions are contractually binding; photographs and visuals are for illustration only.
Prices are shown in euros, VAT not applicable (article 293 B of the French General Tax Code). Vitis Cordis reserves the right to change its prices at any time; the applicable price remains the one in force on the day of the order.
The price of a package corresponds to a sponsorship for one season (article 6).
A sponsorship is concluded for one sponsorship season. The season runs from the end of the previous year's harvest to the end of the current year's harvest: "season 2027" therefore runs from the 2026 harvest to the 2027 harvest. The end-of-season date, which is the customer's last day of access to their personal space, is set each year by Vitis Cordis according to the harvest calendar.
When ordering, and up to a sales cut-off date set each year by Vitis Cordis, the customer chooses to start their sponsorship immediately (current season, until the next harvest) or with the following season. The time remaining in the current season is displayed before the order is confirmed: it may therefore be less than twelve months. After the sales cut-off date, every sponsorship applies to the following season, which starts after the harvest.
At the end of the season, the sponsorship ends: access to the personal space is closed and the vine is made available to other sponsors, unless renewed for the following season (article 7).
The experiences included in certain packages (visit, tasting, morning or snack in the vines) are scheduled from the personal space (article 9): they must therefore take place during the sponsorship season.
For the Discovery, Passion, Privilege and Champagne Immersion packages ordered without a partner code, payment is made online by credit card, via a secure payment handled by Stripe. Payment confirms the order.
Once the order and payment are received, Vitis Cordis confirms the allocation of the vine and sends the customer a confirmation email, normally within 48 hours. This email summarises the order and gives access to the customer's personal space (email address and personal access code).
For the business offer, as well as for any order placed using a partner code, the request is sent to Vitis Cordis, who confirms it within 48 to 72 hours and informs the customer of the applicable payment terms.
For packages with automatic annual renewal, each renewal corresponds to a new sponsorship season. The customer is notified by email before each renewal and may cancel at any time, with no obligation, via the management link provided or by contacting Vitis Cordis.
Vitis Cordis reserves the right to refuse or adjust an order in the event of unavailability (vine already sponsored), by offering the customer an alternative and, where applicable, a full refund.
Orders over €120 are archived by Vitis Cordis for ten years. The customer may access this archive on simple request at contact@vitiscordis.fr.
Vitis Cordis may partner with third-party establishments (hotels, restaurants, event organisers) that include a symbolic vine sponsorship as part of their own commercial offer (for example a picnic basket), in the form of a code giving access to a Vitis Cordis package.
In this case, the partner sells its own product or service, for which it is solely responsible; it is neither a reseller nor an agent of Vitis Cordis for the sponsorship itself. The end customer completes their sponsorship request directly with Vitis Cordis, via the site, using the code they were given: the sponsorship contract is concluded directly between the customer and Vitis Cordis, under these terms.
A partner code grants access, at no extra cost, to the content of the corresponding package as specified when the partner purchased the code (excluding, where applicable, the Champagne bottles). The customer may, if they wish, upgrade to a higher package by paying the price difference directly to Vitis Cordis.
Once the order is confirmed, the customer accesses their personal space with their email address and personal access code, throughout the sponsorship season. They follow the progress of their vine there and, where applicable, schedule the experience included in their package.
Proposing and confirming dates. For packages that include an experience (visit and tasting at the partner Champagne house, visit of the plot, morning with breakfast or afternoon with a snack in the vines), the customer proposes, from their personal space, three dates when they are available, at least 15 days in advance. Vitis Cordis confirms one of these dates and informs the customer by email and in their space. If none of the three dates is suitable, Vitis Cordis informs the customer, who then proposes three new dates.
Cancelling a confirmed date. The customer may cancel the confirmed date from their personal space up to three (3) days before the scheduled date (for example, for an experience set for the 15th, up to and including the 12th). They then propose three new dates, and the confirmation procedure above applies again.
Less than three (3) days before the confirmed date, the date can no longer be cancelled or changed. [TO BE CONFIRMED: state the consequence of a no-show or late cancellation — for example, the experience is considered as having taken place, with no rescheduling or refund.]
Cancelling a date is not a withdrawal from the sponsorship contract and does not give rise to a refund: it only allows the experience to be rescheduled, within the sponsorship season.
Point to be confirmed with a legal professional. As the vine is allocated and the certificate personalised as soon as the order is confirmed, an exclusion or adjustment of this right may apply for clearly personalised goods (article L221-28, 3° of the French Consumer Code). For packages including an experience on a fixed date (visit, morning in the vines), the right of withdrawal may also be excluded or adjusted under article L221-28, 12° of the same code.
Bottles are shipped to the address provided by the customer when ordering, within mainland France. An additional charge or delay may apply for shipments outside mainland France; the customer is informed of this before the order is confirmed.
Delivery is included in the price of packages that include bottles. [TO BE COMPLETED: shipping time announced to the customer; failing that, bottles are shipped no later than 30 days after the order is confirmed.]
Point to be finalised before any actual international shipping is offered. Shipping alcoholic beverages to other European Union countries is subject to specific customs regulations (commercial accompanying document, excise duties potentially due in the destination country). This option will only be enabled on the site once the corresponding steps have been completed with the customs authorities.
For packages including a visit or experience on the plot, the customer agrees to follow the safety instructions provided by Vitis Cordis. As Vitis Cordis's activity does not fall under a regulated profession category, taking out professional liability insurance is not a general legal obligation; it remains strongly recommended given that members of the public are received on the premises, and [TO BE CONFIRMED: state here whether such insurance has been taken out].
These terms are governed by French law. In the event of a dispute, the customer may refer the matter to a consumer mediator before taking any legal action: [MEDIATOR TO BE COMPLETED]. Failing an amicable resolution, French courts shall have sole jurisdiction.
